Smoke alarm maintenance is bound by various state and federal legislations. It is considered an offence if they are not complied with. STATE LEGISLATION

As of 1st of July 2007, the Queensland Fire and Rescue Service Act 1990 was amended to include legislation requiring that every smoke alarm in a Queensland rental property must undertake regular maintenance. As a result, landlords and real estate agents must test and clean every smoke alarm in the property within 30 days before a tenancy renewal or changeover. Each smoke alarm battery must also be replaced before the expiry date.

*Under this legislation, it is prohibited to transfer these responsibilities to the tenant.

Please note: Existing smoke alarms that are older than 10 years must be replaced with AS 3786-2014 compliant photoelectric smoke alarms.

UPCOMING LEGISLATION

As set out by the Fire and Emergency Services (Domestic Smoke Alarms) Amendment 2016, there has been a new state-based legislation for QLD rental properties that must be met by 2022.

These additional measures include:

  • Every bedroom of a home must have a smoke alarm installed
  • All smoke alarms must be powered by a 10-year lithium battery or a 240-volt hardwired system
  • All smoke alarms must be interconnected
  • All smoke alarms must be photoelectric (not ionised)
  • All smoke alarms must meet Australian standard 3786-2014
